Acceptance of Terms

By accessing and using the services provided by generaixoo B.V. ("generaixoo," "we," "our," or "us"), including our website at generaixoo.live and our fitness facilities located at Kastanjelaan 102, 3528 AF Utrecht, Netherlands, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

About generaixoo

generaixoo is a women-only fitness club registered in the Netherlands as generaixoo B.V. with registration number B56302592 and VAT number NL62015934B02. We provide fitness services, personal training, group classes, and wellness programs exclusively for women in our Utrecht facility.

Membership and Services

Our services are available through various membership options and individual service packages. By purchasing a membership or service, you enter into a contract with generaixoo subject to these Terms and any specific membership agreement.

• Memberships are non-transferable and for personal use only
• Membership fees are payable in advance and non-refundable unless otherwise specified
• We reserve the right to modify membership fees with 30 days' written notice
• Services are subject to availability and may require advance booking

Facility Rules and User Obligations

All members and visitors must comply with our facility rules and policies:

• Use equipment safely and as intended
• Respect other members and staff at all times
• Maintain appropriate hygiene and dress code standards
• Follow all posted rules and staff instructions
• Report any injuries or incidents immediately to staff
• Respect the women-only environment and policies
• Not engage in any illegal, harmful, or disruptive behaviour

Health and Safety

Your health and safety are our priority. By using our services, you acknowledge:

• You are physically capable of participating in fitness activities
• You will consult with a healthcare provider before beginning any exercise program
• You will inform us of any health conditions that may affect your participation
• You participate in all activities at your own risk
• You will follow all safety guidelines and instructions provided by our staff

Intellectual Property

All content, materials, and intellectual property associated with generaixoo, including but not limited to our website, logos, workout programs, training materials, and proprietary methods, are owned by or licensed to generaixoo and are protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, reproduce, or distribute our content without written permission
• Use our trademarks or logos without authorisation
• Record or photograph our facilities or programs without consent
• Reverse engineer or copy our training methods or programs

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Payment Terms

Payment for memberships and services must be made in accordance with the agreed terms:

• Membership fees are charged in advance according to your chosen billing cycle
• Late payments may result in service suspension and additional fees
• All prices are in Euros and include applicable VAT
• We accept various payment methods as displayed at our facility and website

Cancellation and Termination

Either party may terminate the membership agreement under the following conditions:

• Members may cancel with 30 days' written notice
• generaixoo may terminate membership immediately for violation of these Terms
• Refunds for prepaid services will be provided on a pro-rated basis where required by law
• Upon termination, access to all services and facilities will cease immediately

Limitation of Liability

To the maximum extent permitted by Dutch law, generaixoo's liability is limited as follows:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid by you for services in the 12 months preceding the claim
• We are not liable for personal injuries except where caused by our gross negligence or wilful misconduct
• We are not responsible for lost or stolen personal property
• We are not liable for service interruptions due to circumstances beyond our reasonable control

Indemnification

You agree to indemnify and hold harmless generaixoo, its directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

Force Majeure

generaixoo shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, pandemics, or other force majeure events.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Utrecht, Netherlands.

Dispute Resolution

We encourage the resolution of disputes through direct communication. If a dispute cannot be resolved informally, it may be submitted to mediation before pursuing legal action. Any legal proceedings must be commenced within one year of the dispute arising.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.

Modifications

generaixoo reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website or notification to members. Continued use of our services after changes constitutes acceptance of the modified Terms.

Entire Agreement

These Terms, together with our Privacy Policy and any specific membership agreement, constitute the entire agreement between you and generaixoo regarding the use of our services and supersede all prior agreements and understandings.
